This updated study examines the legal framework, challenges, and future prospects of performers’ rights in Europe. It outlines the evolution of neighbouring rights, differences between exclusive and remuneration rights, and the critical role of collective management. Despite progress, performers—especially in the audiovisual sector—face systemic imbalances and outdated legal provisions that fail to secure fair remuneration in the digital age. The report stresses the need for technology-neutral application of existing rights, greater transparency, and harmonisation of EU laws. Key recommendations include introducing unwaivable equitable remuneration for streaming, updating private copying systems, ending discrimination between music and audiovisual performers, and ensuring enforceable transparency obligations.
