While GenAI offers significant growth potential, it blurs traditional lines of human-generated content, raising profound questions about copyright’s role in balancing innovation and protection. The lack of transparency around GenAI’s inputs, functioning, and outputs complicates understanding its copyright implications. Key questions include how GenAI uses protected content, the applicable EU legal framework, opt-out mechanisms for rights holders, technologies for identifying AI-generated content, and licensing opportunities. The study aims to address these questions to clarify GenAI’s development from a copyright perspective.
